Welcome to Simplystication (“Simplystication,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of www.simplystication.com (the “Site”) and any purchase you make through it. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2.1 Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on this Site. By using the Site, you represent that you meet this requirement.

2.2 Products and Product Descriptions

  • We make every effort to display our oil perfumes, including scent descriptions and packaging, as accurately as possible. Actual colors, bottle appearance, and scent perception may vary slightly due to screen settings, batch variation, and individual scent perception.

  • Our products are fragrance oils intended for personal cosmetic use. They are not intended to diagnose, treat, cure, or prevent any disease, and no statements on this Site should be interpreted as medical advice.

  • We reserve the right to limit quantities, discontinue products, or correct pricing/description errors at any time without prior notice.

2.3 Orders, Pricing, and Payment

  • All prices are listed in U.S. Dollars and are subject to change without notice.

  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If your payment has already been processed for a cancelled order, we will issue a full refund.

  • Applicable sales tax will be added at checkout for orders shipped within California and any other jurisdiction where we are required to collect tax.

  • Payments are processed securely through third-party payment processors. We do not store your full payment card details on our servers.

2.4 Shipping

Shipping timelines, costs, and carrier details are provided at checkout and in our Shipping Policy. Title and risk of loss for products pass to you upon our delivery to the shipping carrier, unless otherwise required by law.

2.5 Returns

All returns and refunds are governed by our Return & Refund Policy above, which is incorporated into these Terms by reference.

2.6 Intellectual Property

All content on this Site — including the Simplystication name, logo, product names, photography, graphics, and text — is the property of Simplystication or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

2.7 User Conduct

When using the Site, you agree not to:

  • Violate any applicable law or regulation

  • Attempt to gain unauthorized access to the Site, its servers, or connected systems

  • Use any automated system (bots, scrapers) to access the Site without our permission

  • Upload or transmit viruses, malicious code, or unsolicited advertising

  • Impersonate any person or misrepresent your affiliation with any person or entity

2.8 Accounts

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

2.10 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIMPLYSTICATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

  • These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

  • Informal Resolution: Before filing a claim, you agree to contact us at contact@simplystication.com so we can attempt to resolve the dispute informally.

  • Arbitration: Any dispute that cannot be resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in [Sacramento], California, except that either party may bring an individual claim in small claims court. You and Simplystication each waive any right to a jury trial or to participate in a class action.

2.13 Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2.14 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
